Welcome to SkySim. These Terms of Service ("Terms") govern your access to and use of the SkySim website, mobile applications, and eSIM services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our Services. We reserve the right to modify these Terms at any time, and such changes will be effective immediately upon posting on this page.

2. Eligibility

To use our Services, you must be at least 18 years of age or have obtained valid parental or guardian consent. By using SkySim, you represent and warrant that:

• You are at least 18 years old, or you have parental/guardian consent
• You have the legal capacity to enter into a binding contract
• The information you provide to us is accurate, complete, and current
• You will comply with all applicable laws and regulations

3. Account Registration and Security

To purchase eSIM products or access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. SkySim will not be liable for any loss or damage arising from your failure to safeguard your account information.

We reserve the right to suspend or terminate your account if we suspect fraudulent, abusive, or unlawful activity.

4. eSIM Products and Services

SkySim provides prepaid eSIM data plans in partnership with China Unicom (Cuniq) and other telecommunications providers. All eSIM products are digital goods delivered via QR code or activation details to your registered email or account dashboard.

Before purchasing, you are responsible for ensuring that:

• Your device supports eSIM technology
• Your device is unlocked and not restricted by a carrier
• The eSIM plan is compatible with your destination country or region
• You understand the validity period, data allowance, and terms of the specific eSIM plan

Product descriptions, coverage maps, and pricing are subject to change without notice. We make every effort to ensure accuracy, but we do not guarantee that all product information is error-free.

5. Orders and Payments

All prices listed on SkySim are in the currency displayed at checkout (default USD) and are inclusive of applicable taxes unless otherwise stated.

By placing an order, you authorize us to charge your selected payment method for the total amount, including any applicable fees. We accept various payment methods including credit cards, Alipay, and other methods supported by Stripe.

Once an order is confirmed and payment is successfully processed, the eSIM activation details will be delivered to your registered email or made available in your account dashboard. Delivery is typically immediate but may occasionally take up to 24 hours.

Orders are considered final once the eSIM has been activated or used. Please review our Refund Policy for information on cancellations and refunds.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using our Services for any illegal, fraudulent, or unauthorized purpose
• Attempting to gain unauthorized access to our systems or other users' accounts
• Reselling, redistributing, or transferring eSIM products without our written consent
• Interfering with or disrupting the integrity or performance of our Services
• Using automated systems or software to extract data from our website (scraping)
• Submitting false or misleading information during registration or checkout
• Engaging in any activity that could damage our reputation or business interests

7. Intellectual Property

All content on the SkySim website and applications, including but not limited to text, graphics, logos, images, software, and product descriptions, is the property of SkySim or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SkySim and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Service interruptions, network coverage issues, or device incompatibility
• Unauthorized access to or alteration of your transmissions or data
• Any errors, omissions, or inaccuracies in our product information

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount you paid to SkySim for the specific product or service giving rise to the claim.

9. Disclaimers

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Services will be accurate or reliable
• Any errors in the Service will be corrected
• Network coverage, speed, or quality will meet your expectations in all locations

eSIM connectivity depends on local network infrastructure and carrier partnerships. SkySim does not control third-party network providers and cannot guarantee service availability in all areas.

10. Indemnification

You agree to indemnify, defend, and hold harmless SkySim and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SkySim operates, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute may be resolved through binding arbitration or the courts of competent jurisdiction.

12. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice, including if we believe you have violated these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
